In order to save costs and time, and the obvious emotional stress, we would aim to achieve your desired result by negotiating consent orders. If this is not possible, then we have an expert team to assist you in pursuing your case through the courts.
When a relationship ends then, either as a precursor to an ultimate divorce, or in the case of any other form of partnership break up, then it is often advisable to formally agree arrangements between the parties. These can relate to a number of issues, such as distribution of financial assets, contact with children, living arrangements, and even agreement with regard to an ultimate divorce and its associated costs. We can advise on, and negotiate these agreements. This creates certainty for the parties and can greatly reduce the potential costs involved in any separation.
Long term relationships which may not be otherwise legally recognised, as with marriage or a business partnership, may still give rise to rights and obligations which the parties may not be aware of. We can help and advise on your behalf, and much of what is said above about separation agreements can apply to these situations.
Whilst as not yet fully recognised by the courts in this country, these are becoming more widely used, will carry some weight, and are likely to do so even more in the future. These agreements can set out the parties respective positions in the event of an ultimate separation, and therefor create more certainty for the parties, and less likelihood of expensive future litigation. We can advise on the form and suggest suitable content for such agreements.
